Am i the asshole?(also im back after 3 days of not being active)

so i have this romanian teacher im from romania i will not mention any names apprances or anything to keep they're identity secret 

So i have this romanian teacher which is like the biggest bitch she always comes in class and eats infront of us and watches facebook everyday but somehow we are not allowed to the bathroom,we are not allowed to eat,we are not allowed with phones during hours but we do on breaks and she doesnt teach us anything and she always gossips us on our class teacher and she's really strict and she really takes advantage of it and idk what to do untill one day i snapped also a little background info i'm 5th grade entering 6th this year i'm 13 but i stayed more time in kindergarden thats why i'm in a lower grade but you can consider i'm in 6th-7th grade anyways back to the subjects so i'm in fifth grade and she gaves a 10th grade assigment and you might wonder how do i know this my mom is a romanian teacher at the same school but only teaches high school and am i the asshole for calling her more uneducated than us for not doing anything with us in class just eat and watch facebook and then gives us a 10th grade assigment?

also forgive my grammar i speak english fluently currently learning german and also might start japanese
