Has the older boy been unjust?
Now let's say that the chocolates were gifted to the older brother, and he eats all of them. Is he still unjust?

The older brother is unjust for eating the whole box of chocolates that they were meant to share.
The older brother is selfish yes, but not unjust in the second example, as he has no obligation to share the chocolates with his brother.
