Jones, Smith and the Coat

Jones is a homeless man who is living on the streets in the dead of winter. And a specifically cold one at that.
Jones has no method of staying warm, and he will not survive the night if he doesn't find something to keep him warm.
While wandering, he spots a miracle. A coat laying on the ground.
He grabs the coat, but so does another homeless man, Smith.
Turns out the coat belongs to him.
Both men start fighting over the coat, but only one of them can have it.
Only one man can have the coat.
Who should get it?
